3.1 In the event that the member’s account lacks sufficient funds on the scheduled debit date (typically the 28th of each month), and the payment is reversed by the bank (i.e., a chargeback), the member shall incur a fixed administrative fee of €7.80 (excluding VAT).
3.2 If the member anticipates an insufficient balance prior to the scheduled debit date, they must notify their assigned model coach no later than 48 hours before the 28th of the month to request a temporary postponement. Approval of any deferment is at the sole discretion of Disstrikt Models and must be confirmed in writing.
3.3 If the member personally initiates a payment reversal (chargeback) without prior written notice to Disstrikt Models, an administrative fee of €7.80 (excluding VAT) will likewise be applied.
3.4 In cases where no response or payment is received after three (3) written reminders, Disstrikt Models reserves the right to engage a third-party debt collection agency. All additional fees and legal costs incurred through collection services shall be borne by the member.
3.5 If one or more payments are reversed or withheld without any form of communication with Disstrikt Models, the member shall be liable for a surcharge of up to 15% of the total outstanding amount, in addition to the original fees.
3.6 In the event of a delayed payment, the member shall be considered in default (verzuim) immediately and without the need for further notice or demand. Disstrikt Models shall be entitled to claim:
Statutory interest (as defined under Dutch Civil Code Article 6:119 or 6:119a, where applicable) over the unpaid amount;
Extrajudicial collection costs, in accordance with Article 6:96 paragraph 2 sub b and c BW, calculated at a minimum of 15% of the principal sum.
3.7 The member expressly acknowledges their liability for all outstanding balances, penalties, interest, and collection costs under this clause and agrees to bear the full responsibility thereof.
4: Services Provided to Active Members
4.1 Active talents with a valid and current membership at Disstrikt are entitled to access the full range of services and benefits provided by the agency.
4.2 The standard “Talent Route” offered to all active members includes, but is not limited to, the following components:
Model training session which includes; posing, walking & setting up model and talent profiles (Model Bootcamp session)
Initial model skills training session (Model Skill Shoot);
Portfolio building photoshoot (Portfolio Shoot);
Three (3) job hunting guidance sessions (Job Hunting 1, 2, and 3);
Physical audition and aptitude testing (Audition + Test).
4.3 Photoshoots & Studio Access
4.3.1 Active members are entitled to unlimited access to photoshoots, job searching, podcasts and other creative aspects at Disstrikt Models’ designated studios, without requiring a prior appointment. These sessions may be walk-in and must be initiated by the talent or artist with their own creative concept and preparation.
4.3.2 The term “unlimited” is defined as a maximum of one (1) appointment per day, resulting in a potential of up to 365 appointments per year.
4.3.3 Talents and creatives are responsible for editing their own photos. Disstrikt does not provide photo retouching services.
4.3.4 Talents and creatives have access to all editing software and programs available on the in-house iMac computers. Editing support is available via:
Direct coaching assistance,
Instruction manuals provided at each station,
Guidance from coaches present in the studio.
4.3.5 Each shoot is limited to a maximum duration of thirty (30) minutes on busy days and 120 minutes on quiet days to ensure fair access for all members.
4.4 International Talent Experience Program
4.4.1 Talents and creatives who successfully complete their physical audition and testing phase qualify for an international model experience trip, arranged in partnership with one of Disstrikt’s affiliated brands.
4.4.2 The agency will fully cover the cost of return flight tickets, in-country transportation (e.g., Spain), and accommodation in the official Disstrikt penthouse or villa.
4.4.3 Each participating talent and creative will receive:
Two (2) professional photoshoots,
A content script,
Access to planned team-building and cultural activities (including excursions to Alicante or Valencia).
4.4.4 Cancellations of the trip made before the tickets are bought are free of charge.
4.4.5 If cancellation occurs after the tickets have been bought, the talent or creative is liable for 100% of the costs.
4.4.6 Travel coverage applies only to the talents and creatives. If a talent or creative elects to bring a guest (e.g., parent or friend), the guest’s expenses must be covered in full by the guest or the talent/creative. Disstrikt may provide a reduced rate for villa accommodation where possible.
4.4.7 Talents under the age of 18 must be accompanied by at least one (1) parent or legal guardian. Guest costs, however, remain the financial responsibility of the guest or guardian.
4.4.8 Disstrikt accepts no liability for damage, loss, or theft of personal belongings, nor for any personal injury sustained during the trip. All talents and creatives are advised to take out travel and health insurance prior to departure.
4.5 Studio & Equipment Access
4.5.1 All active members may access Disstrikt Models studios on a walk-in basis, seven (7) days per week, subject to published opening hours.
4.5.2 Members may use the content creation hub, including professional-grade equipment such as cameras, stabilizers, lighting kits, and sound systems.
4.5.3 Members may use the on-site Apple computers and associated editing software for content production. For assistance, model coaches are available on site.
4.5.4 The studios are designed to encourage collaboration. Members are encouraged to connect and co-create with other members and artists present.
4.5.5 Members may bring friends to the studio to assist with photography, content creation, or support. However, any non-member entering the studio for creative use must purchase a day pass.
4.5.6 All members are encouraged to independently search and apply for work opportunities using Disstrikt’s internal platforms. Coaches are available to assist with login access and navigation of these systems.
5.1 Disstrikt operates under a performance-based commission structure.
5.2 No commission shall be deducted from any income generated by a talent until the total amount earned through the agency within a given calendar month equals or exceeds the value of the monthly membership fee.
5.3 Once the talent has recouped the equivalent of their monthly membership fee within the same month, a commission rate of twenty-five percent (25%) shall apply to all additional gross earnings facilitated by Disstrikt during that period.
5.4 A monthly summary of all completed jobs, corresponding earnings, and applicable commissions shall be provided to each talent by the end of each month. Payment of the net balance will be transferred to the bank account specified by the talent.
5.5 External Jobs
5.5.1 Talents are required to disclose any modeling, performance, or promotional jobs acquired independently, outside the scope of Disstrikt.
5.5.2 No commission shall be charged on such independently obtained work; however, disclosure is necessary to avoid conflicts and maintain transparency in scheduling and branding.
5.6 Use of Booking Platforms
5.6.1 To prevent scheduling conflicts, overbookings, or double representation, members are strictly prohibited from independently creating accounts on any of the job or casting platforms used by Disstrikt.
5.6.2 The current list of such platforms can be requested at any time from the talent’s assigned personal agent.
5.6.3 Violation of this clause may result in removal from the platform, suspension of membership privileges, or termination of the agreement, at the discretion of Disstrikt.
6: Additional Provisions
6.1 Activity Cancellations & Late Fees
6.1.1 Talents and creatives may cancel scheduled activities related to the Disstrikt training route free of charge, provided the cancellation is made prior to 09:00 AM on the day of the scheduled activity.
6.1.2 If a cancellation is made after 09:00 AM, whether by the talent or a coach, a late cancellation fee of €10.00(excluding VAT) will apply and will be charged to the talent.
6.2 Membership Fee Purpose
The monthly membership fee charged by Disstrikt covers access to the studio infrastructure, including professional equipment, on-site assistance by model coaches, and the usage of the facilities as outlined in these terms.
6.3 Age & Consent Requirements
6.3.1 By registering, the talent and/or creative affirms that they are either:
(a) 18 years of age or older, or
(b) have obtained verifiable parental or guardian consent, and in doing so, accept all terms, including those outlined in Disstrikt’s general terms & conditions and third-party service provider agreements (such as GDPR compliance via Stripe).
6.3.2 In accordance with Dutch law, the minimum age to sign a model agreement is 16 years. If the model is under the age of 16, the agreement must be signed on their behalf by a legal guardian or authorized adult.
6.4 Business Registration & Tax Deductions
Talents may register themselves as sole proprietors or freelancers in their country’s commercial trade register. This enables the model to deduct eligible business expenses such as travel, membership fees, and creative production costs (e.g., wardrobe). Disstrikt offers guidance in preparing quarterly VAT returns via its agent's team.
6.5 Nature of the Agreement
6.5.1 By signing up, the talent or creative enters into a subscription-based service agreement and acknowledges that a monthly fee will be charged accordingly.
6.5.2 This is a non-exclusive agreement, meaning the talent or creative remains free to register with other modeling agencies, provided those agencies also operate under non-exclusive terms.
6.5.3 The parties expressly declare their intention to contract based on an assignment agreement (overeenkomst van opdracht) as defined under Article 7:400 et seq. of the Dutch Civil Code (Burgerlijk Wetboek).
6.5.4 Both parties confirm that no employment relationship exists under Article 7:610 et seq. BW.
6.5.5 This agreement is governed exclusively by Dutch law and is deemed binding once signed by both parties without coercion.
6.6 Rescheduling Policy & Non-Refund Clause
6.6.1 If the member cancels a scheduled photoshoot less than 24 hours in advance, Disstrikt shall not be held liable for compensating coach time or studio costs.
6.6.2 If the model wishes to reschedule such a shoot, a rescheduling fee of €25.00 must be paid before a new appointment is confirmed.
6.6.3 Refunds for previously paid amounts (including membership fees and rescheduling fees) are not permitted. However, unused shoot or activity credits may be used within the following quarter, as approved by management.
6.7 Liability for Damages
6.7.1 Disstrikt is not liable for any damage to or loss of property caused by third parties, including other talents, photographers, or model tutors.
6.7.2 Members are expected to treat studio property and professional equipment with due care.
6.7.3 Any incident resulting in damage must be immediately reported to an on-site coach. A damage report will be drawn up, including a financial assessment for compensation.
6.7.4 Surveillance footage may be reviewed to determine the responsible party.
6.7.5 If the damage amount exceeds the member's financial means, a payment plan will be arranged between the member and Disstrikt.
6.8 Leadership Roles & Compensation
Members who demonstrate exceptional dedication and performance may be offered the opportunity to act as a Disstrikt Tutor.
Model Tutors are permitted to build and mentor a team of up to ten (10) registered talents. The talents or creatives must be found outside the Disstrikt current community.
In return, the Model Tutor receives a monthly compensation of €165.00, payable on the 14th of each month.
